文構造を教えて下さい。

質問

タイトルの件、どうしても文構造がつかめない一文がありますので、
文内の修飾関係などを教えていただけると幸いです。(出来れば和訳も…)

【本文抜粋】

文中のeither - or - の関係と、as provided by... と　as the same may...に繋がり…など、
上手く訳せなくて困っています。

○　解釈（あまり自信はないのですが・・・。）

　「・・・によって規定されている時に」

the US Department of Commerce 以前の文でしょうか。
かなり長いので、省略していたのですが、こちらに載せておきます。
