✜✜✜✜Bank Must Withdraw a Transfer of a Member of its Staffs about to Retire! ✜✜✜✜ Bank, a leading American bank whose headquarters is in Shinagawa, Tokyo, is compulsorily transferring Mr. ✜✜✜✜, who is working for its ✜✜✜✜ branch, to an Osaka branch named “✜✜✜✜ Loan Center.” The announcement was issued on December 10. Mr. ✜✜✜✜ became 62 years old at the beginning of this year, and has only 3 years before his mandatory retirement at the age of 65. He has devotedly worked for the bank for nearly 40 years --- 8 years in Tokyo and some years for one of its Osaka branches, which meant he had to commute by bullet train every day! --- despite the fact that his parents have needed nursing care. Now he has some trouble with his health such as frequent dizzy spells and his usual doctor’s diagnosis says that the transfer could worsen his physical and mental conditions. The Bank Concludes That He Can Be Transferred Ignoring the Doctor’s Diagnosis Apart from those diagnoses, Mr. ✜✜✜✜ has submitted to the bank a medical certificate issued by a medical specialist who treats his dizziness and insomnia which says his employer should give some consideration to his workplace according to his request when he returns to work because he has felt uneasy about his job. Nevertheless, the bank unilaterally ordered him to move to the Osaka branch stating “Dizziness does not work as a reason for him to reject the transfer.” and “The medical certificate does not say that the transfer is impossible.” The bank’s inhumane decision is unacceptable. Order of Transfer During Consultation with a Labor Union Mr. ✜✜✜✜ has long worked as a deputy chairperson of a labor union named ✜✜✜✜ Union, a branch of ✜✜✜✜. He has run every year for an election of the representative of the workers and devoted himself to democratizing the workplace and improving the working conditions of his bank. Every time he was ordered to move to a remote branch (he has been ordered three times actually), he achieved reconciliation through trials and collective bargainings. The reconciliations stipulate that a preliminary conference be held if a worker has to move on the occasion of a transfer and he or she does not want to move. In accordance with this stipulation, his employer held a conference for the transfer, but the employer unfairly announced Mr. ✜✜✜✜’s successor and unilaterally ordered him to move without having thorough discussions. Such a unilateral and irresponsible conduct of the bank ont only ruins the relationship of trust between capital and labor but also ignores the stipulations stated above. The Labor Union Supports the Right to Strike and Ready to Back him up Wholeheartedly The union has established the right to strike against the unfair transfer, and started fighting by conducting a strike by union-designated workers. When Mr. ✜✜✜✜ worked for the Osaka branch, he commuted to Osaka by bullet train because he had to take care of his aged parents living in Tokyo. It took him more than three hours to commute (one way!), which was a tremendous burden on him. In spite of the fact that Mr. ✜✜✜✜ has some trouble with his health, the bank shamelessly leveled such an unacceptable demand at him again. We cannot help feeling furious at the bank’s cruel and inconsiderate decision.
